OnyxOne Terms of Service

1. Acceptance of Terms
By accessing or using the OnyxOne application and website located at https://www.onyxone.io (the "OnyxOne App"), operated by OnyxOne ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the OnyxOne App. If you are using the OnyxOne App on behalf of an organization, you represent that you have authority to bind that organization to these terms.
2. Description of Service
The OnyxOne App is a creator marketing and talent management platform that enables agencies to manage creator relationships, deals, deliverables, tasks, and brand partnerships. The OnyxOne App allows creators to connect their social media accounts, manage their profiles, and collaborate with agencies.
3. Account Registration
To use OnyxOne, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use of your account. You must be at least 16 years of age to use the Service.
4. User Responsibilities
You agree to: use the Service only for lawful purposes and in compliance with applicable laws; provide accurate information about yourself, your organization, and your creators; respect the intellectual property rights of others; not attempt to gain unauthorized access to the Service or its systems; not use the Service to transmit malicious software; and not interfere with or disrupt the Service.
5. Third-Party Integrations
OnyxOne allows you to connect third-party social media accounts (such as TikTok, Instagram, YouTube, and Facebook). By connecting these accounts, you authorize OnyxOne to access and retrieve data from those platforms in accordance with their respective terms of service and our Privacy Policy. You are responsible for complying with the terms of service of any third-party platforms you connect. We are not responsible for the availability, accuracy, or policies of third-party platforms.
6. Content and Data
You retain ownership of all content you upload or create on OnyxOne. By using the Service, you grant us a limited, non-exclusive license to use, display, and process your content solely for the purpose of providing the Service. You are responsible for ensuring you have the right to share any content you upload. We may remove content that violates these terms or applicable law.
7. Agency and Creator Relationship
OnyxOne facilitates collaboration between agencies and creators. We are not a party to any agreements between agencies, creators, and brands. We do not guarantee the performance, availability, or conduct of any user. Agencies are responsible for managing their relationships with creators and brands in compliance with applicable laws.
8. Payment Terms
Certain features of OnyxOne may require payment. All fees are as described on the platform and are non-refundable unless otherwise stated. We reserve the right to change our pricing with reasonable notice. You are responsible for any taxes applicable to your use of the Service.
9. Intellectual Property
The OnyxOne platform, including its design, features, and technology, is owned by OnyxOne and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our written consent. The OnyxOne name, logo, and branding are trademarks of OnyxOne.
10. Limitation of Liability
To the maximum extent permitted by law, OnyxOne shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim. The Service is provided "as is" without warranties of any kind.
11. Termination
We may suspend or terminate your account at any time for violation of these terms or for any other reason with reasonable notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases, and we may delete your data in accordance with our Privacy Policy.
